Contest Dates: Garden City Mazda Grand Opening Give Away Event
Entry Dates: Will run from 12:01 A.M. Eastern Time (EST) on Monday, April 11th, 11:59 P.M. Eastern Time (EST) on Saturday, April 30th (the “Sweepstakes Period”). The Sweepstakes is subject to all applicable federal, state and local laws and regulations.
Who is Eligible: The randomly eligible selected winner must be and provide documentary and satisfactory Proof of active employment as an Educator, Law Enforcement, Or first responder, fire police medical staff employed full time at hospital or nursing homes, or volunteers who work for volunteer fire departments or ambulance or rescue departments.
Eligible Winner must be only to legal residents are 18 years of age or older and have a valid U.S. driver’s license, and entry submission must be timely and satisfy and meet all eligibility requirements.
Employees, officers, directors, agents and representatives of Dealer (“Sponsor”), and its Agents, Affiliates, Advertising Agents and all their respective parent companies, divisions, affiliates, Dealers, subsidiaries, advertising and agencies and any and all other companies associated with the design or execution of this Event (collectively, “Event Entities”) and the immediate families (spouses and parents, siblings and children and their respective spouses, regardless of where they reside) and members of the same household of such individuals, whether or not related) are not eligible to enter or win. Void where prohibited by law.
How to Enter: During the Event Period, entrant must register by the completion of the Event entry form, attached here, and obtain one entry form and then submit it to Dealer for entry. Entrants ARE ONLY ALLOWED TO ENTER ONE TIME. MULTIPLE ENTRY FORMS WILL RESULT IN COMPLETE DISQUALIFICATION.
A valid email address will be required to contact the potential prize winner. Entries generated by mechanical means or by any means which subvert the entry process will be void. All entries become the property of Sponsor and will not be acknowledged or returned.
CAUTION: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND SEEK ANY AND ALL REMEDIES AVAILABLE FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. The Dealership Event Entities are not responsible for: (I) entries that are lost, late, stolen, incomplete, inaccurate, damaged, misdirected, undelivered, garbled, delayed or not received by the Event Entities or their respective agents for any reason, or for any entries submitted in a manner that is not expressly allowed under these Official Rules and all such entries will be void; (ii) any problems or malfunctions, errors, failures or human error that may occur in the receipt or processing of entries, or for destruction of or unauthorized access to, or alteration of, entries, (iii) any causes that jeopardize the administration, security, fairness, integrity or proper conduct of this Sweepstakes, or (iv) any other errors or problems relating to or in connection with this Sweepstakes, whether printing, typographical, human or otherwise, including, without limitation, errors or problems which may occur in connection with the administration of the Event, the processing of entries, the announcement of the prize or in any Event – related materials. All incomplete or non-conforming entries will be disqualified. Sponsor reserves the right to cancel, modify or terminate any portion of the Sweepstakes for any reason, including if fraud, misconduct or technical failures destroy or threaten the integrity of any portion of the Sweepstakes, in the opinion of the Sponsor, or if any problem corrupts the administration, security, or proper conduct of the Sweepstakes as determined by Sponsor, in their sole discretion. In the event of early termination of any portion of the Sweepstakes, Sponsor reserves the right to conduct the Prize Drawing from among all eligible, non-suspect entries received prior to such termination (as applicable). Proof of submitting entries will not be deemed to be proof of receipt by Sponsor.
Prize Drawing: At the end of the Event Period, the Dealer will randomly select One (1) Prize winner from among all eligible entries combined for the entire Sweepstakes Period. Odds of winning depend on the number of eligible entries received during the Sweepstakes Period. The winner will be notified by email. If Sponsor is unable to contact a potential winner within five (5) calendar days, potential winner will be disqualified and another potential winner may be selected as per the method outlined above. Sponsor will have no further obligation to a disqualified potential winner. Potential winners will be required to execute and return an affidavit of eligibility, a liability release, and, a publicity release. If such documents are not returned within the specified time period, Sponsor is unable to contact a potential winner using email address provided or a potential winner is otherwise not in compliance with these Official Rules, he/she will be disqualified and an alternate winner may be selected, at Sponsor’s sole discretion.
Prize: Dealer will pay up to the sum of the value of a 36 month lease for a 2022 Mazda CX-5 2.5 S, 36-month lease, with a total value of Prize of $14,187; all governmental required fees and taxes are excluded and the sole responsibility for up-front payment shall be that of the selected winner. At the sole discretion of the Dealer the payments may be made on a monthly or otherwise basis. Winner is responsible for securing and obtaining proper vehicle insurance, registration requirements, and must maintain all factory recommended service requirements.
Prize Conditions: The Prize winner is solely responsible for any expenses in connection with the prize not expressly described herein as being awarded including, without limitation, any and all federal, state, and local taxes. Prize is non-transferable and no cash redemption or prize substitution is allowed, except at Sponsor’s sole discretion. Prize is awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. All prize details are at Sponsor’s discretion.
Prize winner must prepare and submit all required tax reporting documents including IRS 1099 forms.
ELIGIBILITY FOR THE PRIZE REQUIRES THAT THE PRIZE WINNER HAS TAKE PHYSICAL DELIVERY OF THE VEHICLE AND IN THE EVENT OF A LEASE WINNER HAS SATISFIED ALL OF THE LENDERS/LEASOR HAVE BEEN APPROVED BY THE LENDER AND ALL LENDER AND LESSOR TERMS AND CONDITIONS HAVE BEEN FULLY SATISFIED.
Additional Rules & Restrictions: By participating in this Event, entrants agree to abide by and be bound by these Official Rules and the decisions of the Sponsor, which shall be final and binding in all matters relating to this Sweepstakes. In the event the winner is found to be in violation of any of these Official Rules after prize has been awarded, he/she will be required to forfeit the prize or to reimburse the Sponsor for the stated value of the prize if such violation is found after the prize has been used by such winner. Acceptance of the prize constitutes permission for the Sponsor and its designees to use the winner’s name, city and state of residence and/or likeness for purposes of advertising and trade in any manner or media now or hereafter known, worldwide in perpetuity without limitation or further compensation, notification or permission, unless prohibited by law. By participating, entrant agrees to release and hold Event Entities, Dealer, Agents including its attorneys and advertising agents harmless from and against any and all claims, damages and liability of any kind arising, directly or indirectly, in whole or in part, from or in connection with the acceptance, possession or use/misuse of the prize, participation in the Sweepstakes, or in any prize-related activities, including any travel associated therewith, and entrant assumes all liability in connection therewith.
Arbitration: Except where prohibited by law, as a condition of participating in this Sweepstakes, entrant agrees that (1) any and all disputes and causes of action arising out of or connected with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the entrant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than entrant’s actual out-of-pocket expenses (i.e., costs associated with participating in this Sweepstakes), and entrant further waives all rights to have damages multiplied or increased.
Choice of Law: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the State of New York, USA, and VENUE of any dispute shall be in the State of New York, County of Nassau, only.
Release: By entering the Sweepstakes, each entrant agrees for entrant and for its heirs,
representatives, and all its representatives: to release and hold harmless Dealer and all its agents from any claims, liability, illness, injury, death, loss, litigation, or damage that may occur directly or indirectly, whether caused by negligence, or not, from such entrant’s participation and/or his/her acceptance, possession, use of the Prize or any portion thereof; and Winner agrees to indemnify the Dealership and its Agents from any and all liability or claims relating or arising from the Sweepstakes and does hereby acknowledge that the Dealership and its Agents have not made or in any manner are not responsible or liable for any warranty, representation or guarantee, express or implied, in fact or law, and the Winner agrees by its entry to be bound by these Rules and to waive any right to claim any ambiguity or errors therein or in the Sweepstakes itself, and to be bound by all decision of the Dealership and its Agents., which are binding and final.
Publicity: By entering the Sweepstakes, each entrant agrees for themselves and their
heirs, executors and agents to authorize and allow the positing of their name on any Promotional and or advertising media, in any format, and allow the use of their name, photo, image and likeness, and biographical information for commercial publicity, promotional and advertising purposes in any and all media now or hereinafter known throughout the world and in perpetuity without any additional Compensation, notification, permission, consents, approval of such use.
The Winner further agrees to sign a separate promotional Release and Consent, in accordance.
General Conditions: Dealer reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it including these Official Rules without notice in any manner for or any reason including without limitation if any fraud, technical failure or other factors appears to impair the integrity or proper functioning of the Sweepstakes, as determined by the Dealership in its sole discretion.
The failure of Dealer to comply with any provision or to award a prize due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, governmental authorities outside of the control of the Dealer or other like force majeure events will not be considered a breach of these Rules. Dealer’s failure to enforce any term(s) of these Rules shall not constitute a wavier of same.
